1. What these terms cover
These draft terms are intended for domestic painting and decorating services in England and Wales, bought by an individual mainly for personal use. They cover wall and ceiling painting, wallpaper removal, filling and surface preparation, and painting skirting boards, door frames and doors where listed in your quotation. Commercial or landlord work and work elsewhere need terms appropriate to that contract.
Plastering, structural repairs, damp treatment, asbestos work, electrical work, wallpaper hanging and other specialist work are excluded unless specifically agreed and within our competence. No specialist service is promised by these terms.
2. Quotations & agreeing a booking
We offer free, no-obligation quotations. An enquiry, prepared WhatsApp message or discussion does not confirm a booking. Before you agree, we will provide a written quotation describing the rooms and surfaces, preparation, paint products and finishes, included materials, waste arrangements, total price including any applicable tax, payment schedule and proposed timing. An estimate will be clearly identified and its pricing basis explained.
A contract is formed when you accept the quotation and these terms and we confirm the booking in writing. Acceptance can be by email or text after you have received the documents. We will give you a copy you can keep. Silence, merely visiting this website or creating a project brief does not count as acceptance.
The quotation will state any expiry date. Agreed job-specific details supplement these terms and must not reduce your legal rights. Later website changes do not change an existing contract without your agreement.
3. Preparation, hidden defects & additional work
The quotation includes only the preparation described. Wallpaper or old coatings can conceal loose plaster, damp, mould, unstable paint and other defects that cannot reasonably be assessed beforehand. If discovered, we will explain the issue and pause the affected work where necessary.
We will agree any additional work, specialist referral, price and timing with you before proceeding. There is no automatic extra charge or automatic permission to increase the price. If we cannot agree a safe and suitable way forward, we will discuss ending the affected part fairly and account for payments and properly completed work, subject to your legal rights.
Painting and filling do not cure structural movement, leaks, damp or underlying building defects. We will explain any known limitation before you decide whether to proceed. This does not excuse an unsuitable recommendation or poor preparation by us.
4. Paint, colours & materials
Whether we supply the paint or you supply it will be agreed for each job and recorded in the written quote, including the materials covered by the price. Agree colours, sheen, products, coats and the intended finish before work starts. Screens and small samples can look different in the room, so testing a sample is advisable. Extra coats or colour changes requested after agreement will be discussed and priced before they are undertaken.
If you supply paint or other materials, we will discuss suitability and quantity. If there is a problem we can reasonably identify, we will tell you rather than proceed regardless. We remain responsible for our advice and workmanship; we do not exclude responsibility simply because you supplied a product. Goods supplied by us must meet the standards required by consumer law.
5. Access & looking after your home
Please arrange permission for the work, including any landlord consent, and provide safe access during agreed working hours. Tell us about known hazards, fragile surfaces, access restrictions and relevant building information. Agree furniture moving, protection, parking, water, electricity and toilet access before work starts.
Please remove valuables and small fragile items where practical and keep children and pets away from work areas and wet paint. We will take reasonable care to protect your property. Any extra work caused by unavailable access or changed requirements must be discussed and agreed; there is no automatic call-out or penalty charge.
6. Health, safety & waste
We will plan the work safely, use suitable equipment and take appropriate steps to control dust, fumes and access to the work area. Work may need to pause if unsafe conditions or suspected asbestos, lead hazards or other hazardous materials are identified. Specialist assessment or treatment may be needed before affected work resumes.
Waste handling and any included charges will be set out in the quotation. Waste we produce will be managed in accordance with applicable waste duties and through authorised arrangements where required. These terms do not transfer our legal waste or safety responsibilities to the customer.
7. Timing & delays
We will agree expected dates and tell you if a completion date is essential. Drying times, unsuitable conditions, additional agreed work or events outside reasonable control can affect progress. We will explain delays promptly, take reasonable steps to reduce them and agree revised arrangements where possible.
We do not have an unrestricted right to delay or cancel. Your rights where an agreed essential date is missed, a delay is unreasonable or we breach the contract remain unaffected. If work cannot proceed, we will discuss the appropriate refund or other remedy rather than retain money for work not supplied.
8. Prices, deposits & payment
Payment is accepted by cash or bank transfer. A deposit may be requested for some jobs. Any deposit amount, when it is due, stage payments and the final balance due date will be stated in the written quotation before you agree. The quotation must state the total payable price and what it covers. No fixed deposit percentage or balance deadline is imposed by these website terms. We will not add undisclosed charges or apply a consumer credit-card surcharge.
Deposits are part-payments towards the job and are not automatically non-refundable. Cancellation and refunds follow the rules on our cancellations page. We will provide a clear invoice. If you dispute an amount, tell us promptly and pay any undisputed amount due; we will investigate the disputed part fairly.
For overdue undisputed payments, we will contact you and allow a reasonable opportunity to put matters right before considering a proportionate suspension. No arbitrary late-payment penalty or business-to-business statutory interest is imposed on domestic customers by these terms.
9. Cancellation & early starts
See the cancellation notice, form and early-start information, which form part of these terms. Where the law gives a cooling-off right, a routine decorating booking is not automatically exempt simply because a date is reserved or paint is ordered.
Starting during a statutory cooling-off period requires your separate express request. Agreeing these terms alone is not that request. For contracts made in your home, we will obtain the request on paper or another durable medium. Your right to cancel is not lost merely because work starts.
Outside statutory cancellation rights, any cancellation charge must reflect our reasonable direct net loss caused by cancellation, with savings and replacement work taken into account and no double recovery. We will explain the calculation and refund any excess payment. We will not charge you for cancelling because of our breach where you have a right to end the contract.
We may suspend unsafe work immediately, or end affected work where it cannot lawfully or safely continue. For a material customer breach, we will normally explain the issue and allow a reasonable opportunity to remedy it. We will give reasonable notice where possible and account fairly for payments. If we cancel without customer fault, unused advance payments will be refunded and your other legal remedies remain available.
10. Completion, defects & your rights
We will carry out services with reasonable care and skill, as described and within the agreed time or, if none is fixed, a reasonable time. If a price is not agreed, the law requires a reasonable price. Relevant information we give you about the service can be binding.
We will offer an opportunity to review the finished work. Please tell us about concerns so we can investigate and, where appropriate, arrange repeat performance at no extra cost, within a reasonable time and without significant inconvenience. A price reduction or other remedy may be due where the law provides. Our complaints procedure explains how to raise an issue.
Signing off work or paying an invoice does not remove rights relating to defects discovered later. There is no short reporting deadline in these terms and no extra fixed-term guarantee is promised unless given separately in writing. Follow product-specific drying, curing and care advice.
11. Responsibility for loss or damage
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for a pre-existing defect or unrelated damage that we did not cause or worsen, but we remain responsible for any failure to identify or handle a problem where reasonable care and skill required us to do so.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot legally be excluded or limited. There is no blanket liability cap at the price of the job.
12. Photos, privacy & changes
Necessary job records may include photographs of work or existing damage where appropriate and lawful. Marketing photographs require separate permission; agreeing a decorating job does not give permission to publish your home, name or address.
Read our privacy and cookies information. The customer privacy notice remains a draft pending confirmation of the proprietor’s full legal name and actual data-handling arrangements. No website checkbox replaces a separate early-start request or marketing choice.
13. Disputes & applicable law
Please use the complaints procedure first where practical. This does not prevent you obtaining independent advice, using available alternative dispute resolution or bringing a legal claim. We do not require compulsory arbitration or a distant court.
These terms are intended for work in England and Wales and governed by its laws. Mandatory consumer protections and any right to bring proceedings in your home jurisdiction are preserved. If one provision cannot lawfully apply, that does not remove the rest or your statutory rights.
